BoingBoing blogged about the Ralph Lauren model Flippa Hamilton and the Ralph lauren advertisement she appeared in saying “Dude, her head’s bigger than her pelvis.”
The blog post attracted the attention of Ralph Lauren’s marketing arm and law firm and they weren’t pleased with BoingBoing’s use of the electronically reproduced photo. Ralph Lauren sent a DMCA takedown notice to BoingBoing’s host Canada’s Priority Colo. The DMCA notice can be viewed here.
According to BoingBoing and other experts on the issue, the reproduction falls under fair use and can be reproduced “for purposes such as criticism, comment, news reporting,” etc.READ MORE
